TERMS OF BUSINESS

RESIDENTIAL LETTING SERVICE

A SUMMARY OF SERVICES AND CHARGES IN THE LETTING OF PRIVATE RESIDENTIAL PROPERTIES.

1) YOUR PROPERTY AND LETTING  
Tai Aeron can advise you on any legal requirements and/or improvements that may be necessary to bring your property up to the required standards for letting.
This will include:

  • Gas Safety Certificate
  • Electrical Safety Certificate
  • PATT Testing
  • Fire Safety
  • Furniture Regulations
  • Energy Performance Certificate
  • Legionella assessment

Tai Aeron will also advise you on what equipment such as cookers etc are expected to be in place in a rented property.       

2) TENANCY AGREEMENT
Under the Housing Act 1988 the tenancy will be an Assured Shorthold Tenancy, under which the tenants are guaranteed a six-month term. Consequently, and in most cases, I initially offer the tenants a 6 month contract and, if it is agreed to extend the tenancy after the 6 month initial contract, it then becomes a Statutory Periodic Tenancy. A Statutory Periodic Tenancy is in effect a rolling contract under which 2 months’ notice requiring possession has to be provided by the Landlord or 1 month’s written notice to vacate has to be provided by the tenant.
However, should a landlord prefer a longer initial contract say for 12 or 24 months then this can done. Occasionally, a tenant may request a longer initial contract, due to work commitments, say being employed for a 12 month contract at Lampeter University or similar organisation, or renting whilst building their own home, and so requiring a longer guaranteed period of a let.

3) ADVERTISING AND REFERENCING
Having received instructions to act on your behalf in the letting of your property Tai Aeron will actively market your property in an effort to secure suitable potential tenants.  Tai Aeron has its own website at www.tai-aeron.co.uk and we are also affiliated to Zoopla which gives Tai Aeron a national coverage. Tai Aeron also advertises in the local press mainly the Cambrian News and the Tivy Side Advertiser.
After interviewing potential tenants and assessing their suitability Tai Aeron will seek satisfactory references and, subject to satisfactory replies to our enquiries, Tai Aeron will agree a tenancy.
For tenants from outside the area or ones that are difficult to reference by standard methods, Tai Aeron uses an external company to undertake its references as well as a credit check and a check on any County Court Judgments (CCJ’s) that a potential tenant may have. The cost of this is met by the tenant.

4) CONTRACTS
Contracts and any other legal documentation will be drawn up between the landlord and the tenant(s) for which there is a charge of £40. Normally, once a tenancy has been agreed, the tenant will pay a holding deposit of £500 to secure the property.

5) PAYMENT OF RENT
The rent is payable a month in advance and this will be collected by Tai Aeron as well as a Bond which will be equivalent to one month’s rent. Tai Aeron will then pass on the rent to your bank account within 5 working days of its receipt. Tai Aeron’s commission and any other charges incurred will be deducted from the rent at source.

 

6) BOND AND DILAPIDATIONS
Tai Aeron will obtain a Bond against damages from the tenant, prior to the commencement of the tenancy. The bond will be the same amount as a month’s rent. PLEASE NOTE ANY DEPOSIT (BOND) PAID BY THE TENANT(S) WILL BE HELD BY THE DPS (DEPOSIT PROTECTION SERVICE) WHICH IS PART OF A GOVERNMENT SCHEME – please see leaflet.
When the tenant leaves your property the inventory – see below -  will be checked and a schedule of dilapidations, if necessary, will be prepared and costed.
It must be remembered that the property is subject to a “fair wear and tear” clause and will be subjected to the stress and strains of everyday living. It must be also be accepted that internal decorations may need attention after two or three years of occupation by tenants.

7) INVENTORY
Tai Aeron undertakes to prepare an Inventory of the Contents and a Schedule of Condition of your home at the start of the letting, and to check the Inventory and Schedule of Condition at each change of tenant.
On vacating, the inventory is checked with the tenant in attendance, and dilapidations, if any, are agreed.
When necessary, revised inventories are prepared for subsequent tenants.

8) LOCAL AUTHORITY TAX AND UTILITIES
Local Authorities (council tax), water authority, electricity board, etc will be notified whenever a tenancy commences or terminates.

9) INSPECTIONS
The property will be inspected after the first three months of the new tenancy. Then, depending upon the quality of tenant, further inspections normally occur after another 6 months and then on an annual basis. Based on how the tenants are looking after the property, and in consultation with you, we will determine whether to offer them an extension to the existing contract or to terminate the contract at the end of the initial 6 month stage.

10) GAS SAFETY REGULATIONS 
These stipulate that Landlords must maintain all gas appliances in the property they let to tenants, and that all appliances must be inspected annually by an approved inspector and copies of Landlord’s Certificates issued. Tai Aeron can arrange this to be carried out and the landlord will be deducted the amount out of the first month’s rent.
For gas appliances and multi-fuel stoves a Carbon Monoxide detector must be provided.

 

11) ELECTRICAL SAFETY REGULATIONS
Although there is no statutory requirement to have annual safety checks on electrical installations as with gas, the Landlord must ensure that the electrical installation and all appliances are “safe” with little risk of injury or death to humans, or risk of damage to property. This includes all mains voltage household electrical goods supplied by the landlord.
It is recommended that electrical installation should be checked not later than 10 years after installation.
To cover everyone concerned, if the electrical installation was installed over 5 years previously, Tai Aeron strongly recommends that that you obtain an Electrical Certificate from a qualified electrician and that this is renewed every 5 years. The certificate costs approximately £150 and lasts 5 years.
If the electrical installation is over 10 years old then Tai Aeron insists that you obtain an Electrical Certificate from a qualified electrician and that this is renewed every 5 years. Also any electrical goods should be checked at the commencement of each tenancy. Tai Aeron can arrange this to be carried out and the landlord will be deducted the amount out of the first month’s rent.

12) PATT Testing
All electrical appliances such as cookers, kettles, toasters etc will be checked by a suitable person to ensure that they are safe.

13) FIRE SAFETY
All kitchens must have a fire blanket and we’d recommend a fire extinguisher. Again, Tai Aeron can arrange this to be carried out and the landlord will be deducted the amount out of the first month’s rent.
Every property must have smoke detectors installed.
The chimneys for open fires and log burners must be swept before a tenant takes up residence; once the tenant is in residence it is their responsibility to ensure that the chimneys are swept on an annual basis.
Multi–fuel stoves etc should have been installed by a registered tradesman, please can you supply copies of the certificates of installation. If the stove was not installed by a registered tradesperson then the stove must be checked before tenancy commences. Tai Aeron can arrange for this to be done.

As for gas appliances above, a Carbon Monoxide detector must be provided for multi-fuel stoves, boilers and open fires.

14) FURNITURE
Over 95% of the properties that we manage are unfurnished; however, should the property be furnished or part-furnished it is important that all furniture complies with The Furniture and Furnishings (Fire) (Safety) Regulations 1988.

 

15) ENERGY PERFORMANCE CERTIFICATE
An EPC (Energy Performance Certificate) must be carried out on the property if it does not already hold one. If you have purchased the property or you have had the property on sale during the last 3 years you should already possess an EPC or a copy should be available at your estate agent. Otherwise, Tai Aeron will arrange for the assessment, which costs approximately £70, to be carried out and, again, the cost will be deducted out of the first month’s rent.

16) LEGIONELLA ASSESSMENT
Landlords of residential accommodation have responsibilities for combating Legionnaires' Disease. Health and safety legislation requires that landlords carry out risk assessments for the Legionella bacteria which cause Legionnaires' Disease and thereafter maintain control measures to minimise the risk. Most rented premises will be low risk but it is important that risk assessments are carried out and control measures introduced.

17) REPAIRS
If there are any problems with the property during the tenancy the tenants will contact Tai Aeron and if any repairs etc are required Tai Aeron will contact a relevant tradesman to action the repairs. Tai Aeron will inform you of the need for repairs. If the repairs cost less than £200 Tai Aeron will pay the tradesman directly and deduct the cost from the monthly rent. If the repair is higher than £200 then Tai Aeron may pass on the invoice to you for payment.
Normally it is the landlord’s responsibility to ensure that all items left in a property are maintained in working order, thus even repairs or replacements to old equipment must be paid for by the landlord. You must advise Tai Aeron of any equipment that will not be covered/replaced in the event of a breakdown etc.
Where possible we strongly recommend service and maintenance agreements on central heating systems. Tai Aeron can arrange this on your behalf.
Landlords must ensure that we have full details of any such agreements in order that we can contact any contractors if and when required.
Although, Tai Aeron has an extensive list of tradesmen that it can call on we prefer to use your own tradesmen as they are already familiar with the property.

18) GENERAL
a) Please remember that your property will be subjected to the stresses and strains of everyday living. We must emphasize that it is vital that you remove any items not easily replaceable or expendable.
b) If any maintenance or repairs are required whilst the property is being let, then we will arrange for the work to be carried out, after prior agreement with you, and any invoices will be forwarded to you.
c) You should advise your insurers, both building and contents insurance, of your intention to let the property. They may advise on any additional cover or exceptions that are necessary.
d) Please ensure that all water pipes and storage tanks are sufficiently lagged.
e) We normally expect the property to be T.V. and telephone ready.
f) We normally expect the property to have curtain poles or curtain rails in place, curtains are not essential.
g) The garden should be in a neat and tidy condition with lawns mowed and beds weeded before the start of the tenancy. It will be the tenants’ responsibility to keep the garden in a similar condition throughout the tenancy, however, we place the responsibility for maintaining any hedgerows etc on the landlord.
h) Any oil or gas available at the start of the tenancy will be charged to the tenant and similarly re-imbursed at the end of the tenancy.
i) Please note that the consent of your mortgagee may be required before you enter into a letting agreement with a mortgaged property.
j) Also, by law, details of your income from the letting property are requested by Inland Revenue on an annual basis.
k) Please advise Tai Aeron if you have any intentions to sell the property as we believe that this should be made clear to the tenant before they take up a tenancy at your property.

19) COMMISSION AND COSTS
Tai Aeron charges a flat fee of 10% of the monthly rental and this will be deducted from the rent before being passed on to the landlord.
There is also a charge of £40 for drawing up initial tenancy contracts and this amount will also be deducted out of the first month’s rent. This fee will be charged each time contracts are drawn up for new tenants etc.

20) RESIDENTIAL LETTING AGREEMENT
Notice to terminate this Residential Letting Agreement can only take place at the end of a tenancy, when the tenant has vacated. At the end of each tenancy you will be contacted as to whether you wish Tai Aeron to continue as your agency and to seek new tenants for your property.

ONCE THE PROPERTY HAS BEEN VIEWED AND ASSESSED BY TAI AERON, AND YOU WOULD LIKE TAI AERON TO ACT AS YOUR AGENT, PLEASE COMPLETE THE PROPERTY AGREEMENT FORM AND RETURN TO TAI AERON.
